Tongcheng Business Travel's "Chengyi" large model just cleared China's Cyberspace Administration (CAC) generative AI filing.
For companies operating in or entering the China market, this isn't just industry news — it's a reminder of how the compliance stack actually works.
Three regulations sit on top of each other:
• Algorithm Recommendation Rules (2022) — for recommendation algorithms
• Deep Synthesis Rules (Jan 2023) — for AIGC content
• Interim Measures for Generative AI Services (Aug 2023) — for public-facing AI services
A common trap I see with clients: assuming that an algorithm filing covers generative AI. It doesn't. They are separate tracks with separate substantive reviews — training data provenance, content safety, watermarking, refusal lists, anti-discrimination measures.
Two questions I get almost every week from cross-border clients:
- Does our AI customer service tool need a filing?
It depends on the audience. Public-facing services in China need to go through filing. Internal-only tools sit in a lighter zone — but PIPL obligations still attach when personal information is processed.
- Can a model trained abroad serve Chinese users?
Beyond filing, you also face cybersecurity review and cross-border data flow rules. If training data touched China-resident personal information, the PIPL chain follows the data backwards.
Where this is heading: expect the general framework to layer with sector-specific rules — finance, healthcare, education first. If you're building AI products for the China market, treat compliance as a design input, not a final checkpoint.
Applicable rules and enforcement practice evolve quickly — always confirm with current guidance and licensed counsel for your specific product.
What questions are you seeing on the compliance side of AI deployment? Curious to hear from other cross-border counsel and product leads.
