"Is China's new algorithm regime governance or control?"

That's the headline framing. From a compliance lawyer's seat, the more useful question is: what does a company building AI products for Chinese users actually need to do tomorrow?

Three rule blocks are already in force, not pending:

· Algorithm Recommendation Rules (effective March 2022) — algorithm filing, user opt-out of personalized recommendations, minors protection.

· Deep Synthesis Provisions (effective January 2023) — labeling and management of AI-generated faces, voices, content.

· Interim Measures for Generative AI Services (effective August 2023) — pre-launch safety assessment and algorithm filing for public-facing generative AI.

Stacked together, this is the "new algorithm regime" people are debating — not a single new document.

Three patterns I see cross-border clients miss:

  1. Treating "servers offshore" as immunity. If you serve users inside China and push content to them, the regulator looks at the landing point, not the hosting location.
  2. Treating algorithm filing as a one-page disclosure. It's actually a process — training data sources, safety evaluation, content filtering, human intervention — and you need records that hold up under inspection.
  3. Forgetting that PIPL sits underneath. Algorithms run on data. If your cross-border data transfer compliance is weak, your algorithm compliance won't hold either.

Bigger picture: the EU AI Act is live. US states are moving. Japan and Korea have their own versions. The difference between jurisdictions is the path, not whether there's a path.

For founders building AI products with any China-user exposure: don't wait for a regulator's call. Map which rules touch you, what's missing, and fix it as a long-term cost item.
